Acceptable Use Policy

Effective October 30, 2026

The rules every business must follow when using Swift to call, text and look up leads. They come from US law and carrier requirements, and keep your business, your recipients and Swift out of trouble.

1. Who this applies to

This policy is part of the Terms of Service. It applies to every business using Swift and to each of its Authorized Users. Breaking it is a breach of the Terms. Following it does not by itself make you compliant with the law: you are still responsible for knowing and following every law that applies to you.

3. Do not call and opt-outs

  • Scrub your contacts against the National Do Not Call Registry at least every 31 days and against every applicable state list before any sales call or text, unless a legal exemption truly applies (for example, an existing business relationship within the time the law allows).
  • Keep your own internal do-not-call list and honor it. Swift's Do not call list can hold it.
  • Honor every opt-out request, however the person makes it ("STOP", "unsubscribe", "don't text me", asking on a call), promptly and in any case within the time the law requires. Never ask them to opt out a second way.
  • Never contact someone again after they opt out unless they give you new, documented consent. Do not take a contact off the Do not call list without that consent.
  • Honor do-not-call requests for at least five years.

4. Calling and texting times

Call and text only between 8 a.m. and 9 p.m. in the recipient's local time, or the narrower hours a state requires (some states allow fewer hours, fewer attempts per day, or no sales calls on certain days and holidays). Swift's dialer holds calls to these hours by the lead's location and state, and you can narrow them further, but you are still responsible for the times you call and text.

5. Say who you are

  • Identify your business by name in every text, call and voicemail, and give a way to opt out (for texts, "Reply STOP to opt out").
  • Use caller ID that is accurate and that you are authorized to use. Never spoof or hide a number to mislead, defraud or cause harm.
  • Never claim a referral, relationship or prior contact that didn't happen. Do not tell anyone they were referred by a neighbor, a sales rep or another company unless that person actually referred them.
  • Do not pretend to be a government agency, a utility, a carrier or another business.

6. Dialer and voicemail rules

  • Keep abandoned calls at or below 3% of answered calls in each campaign over each 30-day period.
  • When the dialer drops a call because no rep is free, play a recorded message within two seconds that gives your business name and a phone number the person can call to opt out. Swift's default missed-caller message says both; if you change it in Settings → Dialer, it must still say both.
  • Let a call ring at least 15 seconds or four rings before hanging up.
  • Use voicemail drops and prerecorded messages only with the consent section 2 describes.

7. Call recording

If you record calls, tell the other person at the start of the call. Several states require every party's consent to record. You are responsible for getting it.

8. Message content

You may not use Swift to send content that:

  • is false, misleading, deceptive or fraudulent, including phishing, fake prizes and "you've been selected" scams
  • involves sex, hate, alcohol, firearms or tobacco (including vaping and cannabis), or anything else carriers prohibit
  • promotes high-risk financial offers carriers prohibit, such as payday loans, debt relief or consolidation, credit repair, "get rich quick" offers and cryptocurrency investment, or gambling
  • harasses, threatens, defames or invades the privacy of anyone
  • infringes anyone's intellectual property, or contains malware or links that hide where they lead
  • collects debts, unless you comply with the Fair Debt Collection Practices Act and every other law that applies

Your messages must match the use case and sample messages registered for your brand.

9. Carrier rules

  • Do not spread messages across many numbers to get around carrier limits or filtering ("snowshoeing"), and do not send the same content from many numbers to dodge blocking.
  • Do not exceed the volume your registration allows, and keep complaint and opt-out rates low.
  • Do not use one brand's registration for another business's messages.

10. Emergency and premium numbers

Never call or text 911 or other emergency numbers, N11 service codes, premium (900 and 976) numbers, or emergency lines such as hospitals, poison control and fire or police stations. Never use auto-dialed or prerecorded calls to reach hospital patient lines, or any line where the recipient is charged for the call without consent.

11. Using lead and contact data

  • Do not use lookup data for credit, insurance, employment, housing, tenant screening or any other purpose covered by the Fair Credit Reporting Act.
  • Do not use Swift to stalk, harass, or locate anyone for harm.
  • Protect personal information, use it only for your legitimate sales follow-up, and do not sell or share it with anyone not allowed to have it.
  • Do not enter falsified leads, consent records or sales.

12. System abuse

Do not try to break Swift's security, access another workspace's data, overload the Service, get around its limits or compliance tools, share login credentials, or use bots or scripts except through the access keys and tools Swift provides.

13. Enforcement

If we believe this policy has been broken, we may, without notice, block messages or calls, suspend phone numbers, texting, the dialer or the whole workspace, remove content, end the account, cooperate with carriers and the authorities, and identify you as the sender to anyone who complains. Carrier fines and charges caused by your messages are yours to pay, as are the costs the Terms describe under indemnity.

14. Reporting a problem

If you received an unwanted call or text from a business using Swift, or want to report a breach of this policy, email legal@swiftcrm.tech with the number that contacted you and the date. You can also reply STOP to any text to stop messages from that sender.
