Terms of Service

Effective October 30, 2026

These Terms explain how we provide Swift and what each business that uses it is responsible for. Please read the sections on who sends your communications, your legal responsibilities and your duty to defend Swift carefully.

1. The agreement

These Terms of Service ("Terms") are a binding contract between Swift ("Swift", "we", "us") and the business that creates or uses a Swift workspace ("Customer", "you"). The Acceptable Use Policy at /acceptable-use is part of these Terms.

You accept these Terms by checking the box at sign-up, by accepting an updated version, or by using the Service. Checking the box is your electronic signature. If you accept on behalf of a company, you confirm that you have authority to bind it, and "you" means that company.

Swift is for businesses only. It is not for personal, family or household use, and you must be at least 18 years old to use it.

2. What Swift is

Swift is software for sales teams: lead and contact management, pipelines, a dialer, two-way texting, voicemail drops, automations, lead lookups and reporting (the "Service").

Calls and texts are carried by third-party telecommunications carriers and service providers that Swift contracts with. Swift is not a telephone company or carrier. Swift provides the tools; you decide whether, when, to whom and with what content any call, text or voicemail is sent.

3. Third-party services

Parts of the Service are provided by, or rely on, independent third parties: carriers and phone service providers, sources of public-record and contact data, do-not-call and number-validation services, payment processors and hosting providers ("Third-Party Services"). Swift arranges them, connects them to your workspace and bills you for them, as a reseller or as their billing agent. Swift may change which third party provides a feature.

Where a Third-Party Service has its own terms or acceptable use rules and we show them to you or link to them in Swift, you agree to follow them; breaking them is also a breach of these Terms. Swift does not control and is not responsible for the accuracy, availability or legality of what a Third-Party Service provides.

4. Accounts and users

You may invite your employees and contractors to your workspace ("Authorized Users"). You are responsible for everything your Authorized Users do in Swift, as if you did it yourself, and for making sure each one follows these Terms.

Keep passwords and access keys secret. Tell us right away at the address below if you think an account has been compromised. Information you give us, including at sign-up and for carrier registration, must be true, complete and kept up to date.

5. You are the sender of your communications

Every call, text, voicemail and email sent from your workspace is sent by you, on your behalf, as the seller and sender. For the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR) and every similar law, you are the party that makes, initiates and sends those communications, not Swift.

  • You choose the recipients: you import, enter or buy the contacts, choose the areas and run the lookups, and decide who is called or texted.
  • You write or approve the content. Templates, examples and default messages in Swift are only starting points; once you use one, it is your message and you are responsible for it.
  • You decide the timing: when you dial, when you press send, and how your automations, sequences and dialer are set up. An automation runs only because you configured it.

Swift does not review your contacts, consent or messages before they are sent and has no duty to do so.

6. Your legal responsibilities

You are solely responsible for making sure your use of Swift complies with all laws, regulations and industry rules that apply to you and to the people you contact, including:

  • the TCPA (47 U.S.C. § 227) and the FCC's rules, including consent, autodialer, prerecorded-message and do-not-call rules
  • the FTC Telemarketing Sales Rule, including the National Do Not Call Registry and abandoned-call rules
  • the Truth in Caller ID Act and STIR/SHAKEN rules
  • state telemarketing, "mini-TCPA", do-not-call, call-recording, calling-hour and registration laws
  • the CAN-SPAM Act and state email laws
  • privacy and data-protection laws
  • carrier rules, including A2P 10DLC registration and the CTIA Messaging Principles and Best Practices

This includes obtaining and keeping records of the consent each law requires, scrubbing against the National Do Not Call Registry, state lists and your own internal list, honoring opt-outs, identifying your business, and calling or texting only at permitted times. You must keep proof of consent for at least five years and give it to us within five business days if we ask.

Swift does not give legal advice. Talk to your own lawyer about what applies to your business.

8. Carrier registration

US carriers require each business that texts to register a brand and campaign. You authorize Swift to submit your business name, EIN, address, website, contact details, use case, sample messages and opt-in description to carriers and registries on your behalf. The registered brand is your business, not Swift.

Everything you give us for registration must be accurate, and your actual messages must match the use case you registered. Registration fees, carrier fees and any fines or charges a carrier imposes because of your messages are yours to pay.

9. Compliance tools are aids, not guarantees

Swift includes tools that can help you comply, such as Do not call lists, STOP and START handling, calling-hour limits, consent fields, blocked emergency and premium numbers, and missed-call messages. These tools are provided as a convenience. They do not replace your own compliance program, they may not cover every law or situation, and Swift does not promise they will prevent any violation.

Unless your plan expressly includes it, Swift does not scrub your contacts against the National Do Not Call Registry, state lists or litigator lists. Turning a tool off, changing its settings or working around it is your responsibility.

10. Lead lookups and public records

Lead lookups return information compiled from public records and third-party sources. It may be incomplete, outdated or wrong, and is provided as is.

Lookup data comes from an independent data company. Before your workspace's first lookup, a member who may run lookups accepts that company's data terms for your workspace in Swift, and you must follow them; breaking them is also a breach of these Terms. The lookup fee is that company's price for its data: it sets the price, and Swift shows it as theirs (with the company's name, where you accept its terms and on the pricing page). Swift collects it from your balance as the company's billing agent, without a mark-up, and the company pays Swift a commission for collecting. Paying Swift a lookup fee pays the company for that lookup. Swift may stop lookups for your workspace if the company asks.

A phone number or email found by a lookup does not come with consent to contact that person. You must have the consent the law requires before you call or text any number, however you got it.

Swift gives you a limited, non-exclusive, non-transferable license to use lookup data only for your own business's sales and marketing outreach, in line with these Terms and the Acceptable Use Policy, while your subscription is active. You may not sell, rent, share, publish or give it to anyone else, use it to build or improve a data product, or combine it with other data to identify people for any other purpose. If we, a data source or the person concerned asks for data about someone to be deleted or no longer used, you must delete it and stop using it promptly. Swift removes such data from your workspace on its own; you must also remove it from any copy you keep outside Swift within 15 days.

Lookup data is not a "consumer report" under the Fair Credit Reporting Act, and Swift is not a consumer reporting agency. You may not use it, in whole or in part, to decide anyone's eligibility for credit, insurance, employment, housing or any other purpose covered by the FCRA.

11. Your data

You own the data you and your Authorized Users put into Swift, including contacts, messages and recordings ("Customer Data"). You give Swift permission to host, copy, process, transmit and display Customer Data as needed to provide, secure and support the Service and to comply with law.

You are responsible for having the rights and consents needed to put Customer Data into Swift, including notice and consent for call recording where the law requires every party to agree.

Swift may use de-identified, aggregated information about how the Service is used to operate and improve it. Swift does not sell Customer Data.

12. Fees and payment

You pay the subscription fee for each seat (each member of your workspace) and the usage you incur for calling, texting, phone numbers and lead lookups, at the prices shown on our pricing page or in Settings → Billing when the charge is made (the lead lookup price is the data company's; see Lead lookups). No usage is included with a subscription. Usage is charged against your workspace's prepaid balance, which you fund in advance; a balance can go below zero when a call is already running, and you owe that amount. Funds you add don't expire.

A free trial covers the subscription fee only and needs a payment method on file. Unless you cancel before the trial ends, your subscription starts and the subscription fee is charged to that payment method. Usage during a trial is paid from your balance like any other time.

Subscriptions renew automatically each month or year until cancelled. You authorize us to charge your payment method for subscription fees, usage, automatic refills you turn on, and taxes. Fees are non-refundable except where the law requires otherwise.

We may change prices with at least 30 days' notice for subscription fees; new usage rates apply to usage after they take effect. When the data company changes the lead lookup price, we email the members who manage your workspace's billing at least 14 days before the new price applies. If a payment fails, we may suspend the Service until it is paid.

13. Phone numbers

Phone numbers you get through Swift are assigned to your workspace for as long as your account is active and paid. Carriers and our service providers hold the numbers; you do not own them. If your account ends, your numbers may be released. While your account is in good standing, we will reasonably help you port a number to another provider if you ask.

Calls and texts may be blocked, filtered, labeled or delayed by carriers, and delivery is not guaranteed.

14. No emergency calls

Swift cannot be used to call 911 or any other emergency number, and blocks those calls. Swift is not a replacement for a regular phone service. Keep another way to reach emergency services.

15. Suspension and termination

We may suspend or limit your workspace, a phone number, texting or any feature, immediately and without notice, if we believe that:

  • you or an Authorized User may have broken these Terms, the Acceptable Use Policy or the law
  • we received a complaint, a carrier or service provider asked us to, or carrier registration was rejected or suspended
  • your use puts Swift, our providers, other customers or the public at risk
  • a payment is overdue, or the law, a court or a government agency requires it

You may cancel at any time in Settings → Billing; cancellation takes effect at the end of the current billing period. We may end these Terms for convenience with 30 days' notice, or immediately for a serious or repeated breach. After the account ends you have 30 days to export Customer Data, after which we may delete it, except where the law or a legal hold requires us to keep it.

17. Your duty to defend and indemnify Swift

You will defend Swift and its owners, members, officers, employees, agents, contractors and service providers (the "Swift Parties") against any third-party claim, demand, lawsuit, arbitration, class action, regulatory action or carrier action, and pay all damages, statutory damages, settlements, fines, penalties, carrier charges and costs (including reasonable attorneys' fees and expert costs) that arise from or relate to:

  • any call, text, voicemail, email or other communication sent from your workspace or by your Authorized Users
  • Customer Data, or your collection, consent records or use of any phone number or personal information
  • any consent record, compliance statement or registration information you or your Authorized Users give Swift that is false, incomplete or unsupported
  • your use of lookup data or any Third-Party Service
  • your or your Authorized Users' breach of these Terms or the Acceptable Use Policy, or violation of any law or third-party right
  • your products, services, sales practices or dealings with your own customers and leads

Your duty to defend starts as soon as a claim is made, applies even if the claim is groundless, and does not depend on a final judgment. We will tell you about the claim, and you will hire counsel reasonably acceptable to us. We may take part with our own lawyers; if there is a conflict of interest or you do not defend promptly, our lawyers' reasonable fees are yours to pay. You may not settle a claim in a way that admits fault by, or imposes any obligation on, a Swift Party without our written consent.

18. Disclaimers

THE SERVICE, LOOKUP DATA AND EVERYTHING PROVIDED WITH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, SWIFT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. SWIFT DOES NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY CALL OR TEXT WILL BE DELIVERED, OR THAT YOUR USE OF THE SERVICE WILL COMPLY WITH ANY LAW.

19. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, THE SWIFT PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, SALES, DATA OR GOODWILL, EVEN IF TOLD THEY WERE POSSIBLE.

THE SWIFT PARTIES' TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID SWIFT IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR $100.

These limits do not limit your payment obligations or your duty to defend and indemnify.

20. Swift's property and restrictions

Swift and its licensors own the Service, its software, design and content. We give you a limited, non-exclusive, non-transferable right to use the Service for your internal business during your subscription.

You may not resell or sublicense the Service; copy, modify or reverse engineer it; get around its limits, security or compliance tools; use it to build a competing product; or access it by automated means other than the access keys and tools we provide. If you send us feedback, we may use it freely.

21. Disputes and arbitration

These Terms are governed by the laws of the State of Utah and applicable US federal law, without regard to conflict-of-law rules.

Any dispute between you and Swift arising from or relating to these Terms or the Service will be resolved by final, binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before one arbitrator, in Salt Lake County, Utah. Judgment on the award may be entered in any court with jurisdiction. Either party may instead bring an individual claim in small-claims court, and either party may ask a court for an injunction to protect its intellectual property or stop unauthorized use of the Service.

Disputes will be resolved only on an individual basis. Neither party may bring or take part in a class, collective or representative action against the other. If this waiver is found unenforceable for a claim, that claim will be heard in the state or federal courts in Salt Lake County, Utah, and both parties consent to their jurisdiction.

Any claim against Swift must be brought within one year after it arises, or it is permanently barred.

22. Changes to these Terms

We may update these Terms or the Acceptable Use Policy. When a change is significant, we will ask you to accept the new version in Swift before you continue, and it takes effect when you accept it or keep using the Service. Other changes take effect when posted, and the effective date at the top of the page shows the current version.

23. General

These Terms, the Acceptable Use Policy and any order form are the entire agreement between you and Swift about the Service. If a provision is unenforceable, it will be enforced as far as possible and the rest remains in effect. Not enforcing a right is not a waiver of it.

You may not assign these Terms without our written consent; we may assign them in a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control, including carrier outages. The parties are independent contractors.

Sections on the sender, your legal responsibilities, consent records, lead lookups, legal process, indemnity, disclaimers, limitation of liability, disputes and any unpaid fees survive the end of these Terms.

Legal notices to Swift go to legal@swiftcrm.tech. We may send notices to the email address of your workspace's owner or show them in the Service.
